Terms of Service

These terms are provided as a starting template. Please review them (and ideally have them checked by a qualified adviser) so they match how your business actually operates before relying on them.

These terms apply to website services provided by Fixed Price Websites, a brand of Native Artificial Intelligence (ABN 32 261 010 254) — "we", "us" or "our". By requesting a quote or engaging us to build a website, you (the "client" or "you") agree to be bound by them.

1. Quotes and estimates

The price shown in our online quote builder is an indicative estimate only, not a binding quote. We confirm the final price in writing before any work begins. If your requirements change, the price may be adjusted by agreement before we proceed.

2. Pricing and GST

All prices are in Australian dollars (AUD) and include GST. Native Artificial Intelligence is registered for GST, and a tax invoice will be provided for your records. Prices displayed in other currencies are an approximate conversion for convenience only; all work is quoted and billed in AUD.

3. Payment

Unless agreed otherwise, a deposit is payable to confirm your booking, with the balance due on completion and before final handover or go-live. We will provide an invoice and accepted payment methods (such as a secure card payment link or bank transfer). Work may be paused if payment is overdue.

4. Content and assets you provide

To keep prices fair, you may provide your own logo, images, text and media. If you ask us to create these, the fixed prices shown apply (for example, a simple logo, AI-generated images, or a hero video). You confirm that you own or have the right to use any materials you supply, and that they do not infringe anyone else's rights.

5. Revisions

A reasonable round of revisions is included before launch so we can get the website right. Significant changes of scope, additional pages or features requested after work has begun may be quoted separately.

6. Hosting and domain

Hosting and domain registration are not included in the standard build fee unless you choose our managed hosting option.

• Self-managed: you purchase your own domain and hosting (e.g. through Hostinger) and they remain in your name. We provide the completed files and upload instructions.
• Assisted setup: for a one-off fee we help upload or transfer the completed files to your hosting account, which you still own.
• Managed hosting & maintenance: a monthly subscription under which we host and maintain the website for you. If the subscription is cancelled and you want the website transferred to your own hosting, a transfer fee applies (as shown on our website).

7. Ownership and intellectual property

Once your invoice is paid in full, you own the final website files we deliver. Third-party components (such as fonts, plugins, libraries or stock assets) remain subject to their own licences. Unless you ask us not to, we may showcase your completed website as an example of our work in our portfolio.

8. Timeframes

We work efficiently, but delivery timing depends on the options selected and how quickly you provide content, assets and approvals. We will give you an indicative timeframe and keep you updated.

9. Warranties and liability

We provide our services with due care and skill. Nothing in these terms excludes rights you have under the Australian Consumer Law, which cannot be excluded. To the extent permitted by law, our liability for any claim relating to the services is limited to re-supplying the services or refunding the amount you paid for them. We are not responsible for issues caused by third-party services, content you supply, or changes made by you or others after handover.

10. Termination

Either party may end an engagement by written notice. If you cancel after work has started, fees for work completed up to that point remain payable.

11. Governing law

These terms are governed by the laws of Western Australia and the Commonwealth of Australia, and the courts of that jurisdiction have jurisdiction over any dispute.
